Terms of Service

These terms cover your use of this site and anything you buy from us. Using the site means you accept them.
McIlhattan Media ("we", "us") is the entity providing these services. We operate under the brand name GrowthHackr, which is also the name of our YouTube channel. In these terms, "we" means McIlhattan Media.
What we provide
- The Growth Hackr subscription — $50 for the first month, then $97 per month (the Founding 10 price). Google Ads management is always included. There is no long-term contract and you can cancel any time.
- Optional pieces you choose — a website, a funnel, optimization, SEO and aggressive ranking (a push to rank higher in search). These are optional. You choose which ones you want, and some are available on request rather than built into every account.
- A Leak Report — a free bonus with sign-up. You submit information about your offer, ads and funnel, and we email you an analysis of where the earliest problem appears to be.
- Free educational content — including articles and short videos published on our own site and YouTube channel.
How our output is produced
Our diagnostics, written content and videos are produced by AI systems with human oversight. Our videos are disclosed to YouTube as containing AI-generated content. We think you should know how the thing you are reading or watching was made.
AI systems can be wrong. Everything we give you is information and analysis for you to evaluate and act on using your own judgement.
No professional advice, and no guaranteed results
Nothing we provide is financial, legal, tax, or other professional advice, and nothing we provide is a promise of any particular business result.
We do not guarantee, and do not claim, that you will earn any specific amount, increase revenue, reduce cost per lead, rank at any position in search results, or achieve any other outcome. Any results described anywhere on this site — including any prior client results — are examples of what happened in a specific situation. They are not typical, not a prediction, and not an assurance of what will happen for you. Marketing outcomes depend on your offer, your market, your execution and factors outside anyone's control.
Your responsibilities
- Give accurate information. Work built on inaccurate inputs will be poor work.
- Only submit information you have the right to share. Do not submit other people's personal data, or confidential material belonging to someone else.
- Comply with the law and with the rules of any advertising platform you use. You are responsible for what you publish and how you market.
- Do not misuse the service — no attempts to break, overload, scrape or gain unauthorised access to it, and no automated submission of the intake form.
Payment, ad spend and cancelling
Payments are handled by Stripe under their own terms. The subscription is $50 for the first month, then $97 per month. There is no setup fee, no long-term contract and no percentage of your ad spend.
Ad spend. Your advertising costs are paid by you directly to Google through your own Google Ads account. They are separate from our fee and are not refundable by us.
Cancelling. You can cancel any time. Cancelling stops future billing; the current month is not refunded.
Your accounts and approvals
You keep full ownership of your own ad accounts and everything built in them: campaigns, keywords, ads and data. We access your Google Ads account through a standard manager link you can remove at any time. Campaigns are created paused. Nothing goes live, and no spend increase is made, without your approval.
Intellectual property
The materials we produce and publish remain the property of McIlhattan Media. You keep your own ad accounts and your own business content. You may not resell, redistribute or republish our materials as your own product.
What you submit to us stays yours. You give us permission to process it in order to provide the service, as described in our Privacy Policy.
Access to Leak Report and Growth Hackr DIY
Your Leak Report diagnosis and your Growth Hackr DIY login are personal to you. Both are issued to a single email address and are for your own use.
- Do not share your login or access. Growth Hackr DIY access is tied to your account. Sharing your login, forwarding lesson content, or letting someone else use your access is a breach of these terms.
- Do not redistribute what we send you. Your Leak Report and Growth Hackr DIY lesson content are for your own use, not for republishing, reselling, or passing along as someone else's work.
- We watermark what we deliver. Your diagnosis email and your Growth Hackr DIY lesson pages are marked with your own email address. This does not stop a screenshot or a copy from being taken — nothing on the web can prevent that — but it means a leaked or shared copy can be traced back to the account it came from.
- What happens if we find a violation. We may suspend or permanently revoke access for the account involved, without refund, and — for clear commercial misuse (reselling access, republishing lesson content as your own, systematic redistribution) — we reserve the right to pursue further remedies available to us under the law.
If you're a founding member of either product (free access in exchange for being an early adopter, ideally with a testimonial or case study), the same rules apply to you, and your discounted rate is likewise personal to your account and not transferable.
Third-party services
The service depends on third parties including Netlify, Stripe, Google, Meta, Kit, Anthropic and fal.ai. Their availability is not within our control, and their own terms apply to your use of them.
Availability
We do not promise the site or the automated systems will be uninterrupted or error-free. We may change, suspend or discontinue any part of the service. If we discontinue something you have paid for and have not received, we will refund the unfulfilled portion.
Limitation of liability
To the extent the law allows, McIlhattan Media is not liable for indirect, incidental, special or consequential losses, or for lost profits, lost revenue or lost data, arising from your use of the service. To the extent the law allows, our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the claim.
Nothing here excludes liability that cannot lawfully be excluded.
Termination
You can stop using the service at any time. We may suspend or end access for anyone who breaches these terms or misuses the service.
Governing law
These terms, and any dispute arising out of them or out of your use of the service, are governed by the laws of the State of North Carolina, United States, without regard to its conflict-of-laws rules. You and McIlhattan Media agree that the state and federal courts located in North Carolina have exclusive jurisdiction over any such dispute.
If any part of these terms is found unenforceable, the rest remains in force.
Changes to these terms
We may update these terms. The effective date at the top will change, and continuing to use the service after an update means you accept the revised terms.
